CFDA and WME-IMG Handed Favorable Ruling In Fashion Week, Inc. Lawsuit [The Fashion Law]
A court in New York’s Southern District has ruled in favor of the Council of Fashion Designers of America and WME-IMG in a preliminary injunction in a lawsuit filed against them by Fashion Week, Inc., a rival events production company. Fashion Week, Inc. claimed that the CFDA and WME-IMG’s use of the term “New York Fashion Week” infringed on their trademark. While the judge noted that the plaintiff does have some rights to “New York Fashion Week,” he explained that these rights are limited and apply only to “online entertainment ticket agency sales.” The ruling means that the CFDA and WME-IMG can use the title “New York Fashion Week” in September and continue to use it for the duration of the lawsuit.
