A spokesperson for the Colorado state courts says Thursday’s hearing for James Holmes, the suspect charged with opening fire and killing 12 people at a movie theater’s midnight screening of The Dark Knight Rises in July, was postponed after Holmes allegedly rammed his head against a wall.
Robert McCallum, a representative for the courts, told the AFP news service (via Business Insider) that Holmes’ hearing has been delayed to Dec. 10 following a request for an emergency court session by the 24-year-old’s attorneys.
Holmes has been behind bars at Denver’s Arapahoe County jail since the July 20 attack on an Aurora, Colo., theater, where police say he shot and killed a dozen theatergoers and wounded 58 more. He faces 166 counts of murder, attempted murder and other charges tied to the shooting spree.
According The Denver Post, citing sources, Holmes hurt himself by ramming his head into a wall at the jail. He was sent to the hospital on Tuesday, after which his lawyers — declining to specify the issue — successfully requested a postponement during the emergency hearing, arguing that Holmes has a constitutional right to appear at all of his court hearings.
“In the middle of the day yesterday, we received information for the situation (that) involved a trip to the hospital,” public defender Tamara Brady said Wednesday. “It’s not as simple as a migraine, and it’s not something I feel will resolve by tomorrow morning.”
