Countersuit filed over 'Brutal Legend'

An epic court battle is brewing over the upcoming release of "Brutal Legend," a video game starring Jack Black.

The game's maker, Double Fine Productions, filed a countersuit against Activision Entertainment Inc. last week, alleging the company is trying to stop the release of "Brutal Legend" to protect Activision's "Guitar Hero" franchise.

The countersuit comes roughly a month after Activision sued Double Fine, seeking a judge's ruling to stop the game's October release. That suit claimed Double Fine was paid $15 million, but failed to deliver the game on time and later sold it to Activision's rival, Electronic Arts.

Double Fine's countersuit claims Activision abandoned the project and is trying to harm "Brutal Legend" during a crucial marketing phase.
