Gavin Smith: Convicted Drug Dealer Could Face Death Penalty in Murder of Former Fox Executive

A convicted drug dealer could face the death penalty after being indicted on a capital murder charge in the killing of a 20th Century Fox executive.
John Lenzie Creech pleaded not guilty to the new charge Wednesday in Los Angeles Superior Court in the death of Gavin Smith.
Creech was previously charged with first-degree murder, but prosecutors brought new allegations that he lay in wait to kill Smith three years ago.
Smith's remains were found in the Southern California desert last year.
Creech is serving an eight-year prison sentence for selling or delivering drugs.
Creech's lawyer has said his client defended himself when attacked by Gavin Smith and could have caused a fatal injury. Smith, a former UCLA basketball player, worked for Fox's movie distribution department.
