Tom Petty Performing at The Fonda - P 2013

Those who purchased tickets for the June 8 Fonda Theatre show "deserved to experience the entire performance," writes the band in a statement.

Tom Petty is offering fans who attended his June 8 concert at Los Angeles' Fonda Theatre a full refund.

About 90 minutes into Tom Petty and The Heartbreakers' Saturday night set, the fire marshal shut down the show, insisting that the venue was over capacity by 100 people. Petty then walked back on stage and jokingly asked the audience if a hundred people would like to leave and continued on to play "Melinda." The moment of levity was lost on the marshals, though, and as the band walked off stage, angry and confused fans were ushered out of the building.

On June 9, the band released a statement of noting their disappointment at the events that transpired, It read: "The number of tickets sold was NOT above legal capacity of the building. The venue and Ticketmaster documentation confirms this. Tom Petty and The Heartbreakers and our representatives rely on the concert promoter and venue representatives to give us an accurate breakdown of the legal capacity for every part of the building and to provide security and other staff to enforce this."

Petty went on to express sympathy to their fans for a show cut short promising to ensure the crowd would be reimbursed "even if I have to pay it myself."

Two days later, the band announced that "fans in attendance ... deserved to experience the entire performance," and offered the opportunity for a full refund, as long as its requested by Sept. 10. Ticketmaster also agreed to refund all incurred service fees.
